Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and MentionedOn("MentionedOn", "we", "us") governing your access to and use of mentioned-on.comand our AI visibility monitoring service (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

2. The Service

The Service queries third-party AI assistants with buyer-intent questions and reports whether and how your business is mentioned, along with related metrics, competitors, and recommendations. Features, models, and limits may change as the Service evolves.

3. Free scan & free tier

You can run a free AI visibility scan without an account or a credit card. Creating an account is free and places you on the free tier, which does not require a credit card and will not automatically charge you. Daily monitoring and the full action plan activate only if you choose to start a paid plan. We may offer promotional access at our discretion.

4. Plans, billing & cancellation

• Paid plans are billed in advance on a recurring (monthly) basis through our payment processor, Stripe.
• Subscriptions renew automatically for successive periods until you cancel.
• You can cancel anytime from your account's billing portal. Cancellation takes effect at the end of the current billing period, and you retain access until then.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused features.
• We may change prices on a prospective basis; we will give notice before a change affects your renewal.

5. Acceptable use

You agree not to:

• use the Service for any unlawful, infringing, or fraudulent purpose;
• abuse, overload, scrape, reverse engineer, or attempt to disrupt or gain unauthorized access to the Service;
• circumvent rate limits, usage limits, or security measures, or share access to evade plan limits;
• submit data you do not have the right to submit, or sensitive personal data; or
• resell or provide the Service to third parties except as expressly permitted by your plan.

We may rate-limit, suspend, or terminate access to protect the Service or other users.

6. AI-generated results & no guarantee

Scan results reflect the outputs of third-party language models at a point in time. These outputs are probabilistic and can be incomplete, outdated, or inaccurate, and they change over time. Results are provided for informational purposes only and are not a guarantee of any ranking, mention, visibility, traffic, revenue, or other outcome. You are responsible for how you use the results and recommendations.

7. Your content & our intellectual property

You retain ownership of the business information and content you submit ("Your Content"). You grant us a worldwide, non-exclusive license to host, process, and use Your Content to operate and improve the Service. We (and our licensors) own all rights in the Service, including its software, design, and branding; no rights are granted except as expressly stated in these Terms.

8. Third-party services

The Service relies on third-party providers (including AI model providers, payment, email, hosting, and analytics). We are not responsible for the availability, accuracy, or practices of third parties, and your use of certain features may be subject to their terms.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, MentionedOn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve (12) months before the event giving rise to the claim, or USD $100.

11. Indemnification

You agree to indemnify and hold MentionedOn harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, provide additional notice where appropriate. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute not subject to other agreed dispute-resolution terms.
